Day Laborer Terms of Service & Privacy Policy
Day Laborer is a job-posting platform owned and operated by Nexora Technologies LLC. Day Laborer is not an employer, staffing agency, payroll provider, contractor, subcontractor, or supervisor of any worker or employer using the platform.
1. Job-Posting Platform Only
Day Laborer is a job-posting platform, owned and operated by Nexora Technologies LLC, that enables workers ("Workers") and individuals or businesses seeking help ("Employers") to find each other and arrange work directly. Day Laborer does not employ, provide, send, place, dispatch, screen, vet, guarantee, or manage Workers, does not supervise or control the manner in which work is performed, and does not set work schedules. Employers post jobs and Workers apply directly; all work arrangements are made directly between Workers and Employers.
Employers are solely responsible for hiring decisions. Workers are not employees, agents, or representatives of Day Laborer or Nexora Technologies LLC.
2. No Liability for Work Performed
Day Laborer expressly disclaims any responsibility or liability for the quality, safety, legality, or outcome of any work performed; injuries, property damage, or losses; payment disputes; the accuracy of Worker profiles; or the conduct of any Worker or Employer. Users engage with each other entirely at their own risk.
3. Independent Contractor Relationship
Nothing in these Terms creates an employment, partnership, or agency relationship between Day Laborer, Nexora Technologies LLC, and any Worker or Employer. Workers are solely responsible for their own taxes, insurance, equipment, and compliance with all applicable laws. Employers and Workers are solely responsible for hiring decisions, wages, taxes, insurance, workplace safety, job performance, and compliance with applicable laws.
4. User Responsibilities
By using Day Laborer, you agree to provide accurate information, treat other users with respect and professionalism, comply with all applicable laws, and not use the platform for any illegal or abusive purpose.
5. Payment & Fees
Employer subscriptions ($49.99/month) are processed through Whop. Worker job applications are free. Day Laborer fees are non-refundable. Day Laborer does not handle payment between Workers and Employers — payment is arranged directly between the parties.
6. Limitation of Liability
To the maximum extent permitted by law, Day Laborer, Nexora Technologies LLC, and its affiliates shall not be liable for indirect, incidental, or consequential damages. Day Laborer's total liability shall not exceed the fees you paid in the 3 months preceding the claim.
7. Privacy
We collect your name, contact information, and location to operate the platform. Your location is used only to show nearby jobs and workers. We do not sell your personal information. Location data is not stored beyond your active session unless you grant persistent permission.
8. Changes to These Terms
Day Laborer reserves the right to update these Terms at any time. Continued use constitutes acceptance of the updated Terms.
